The terms You and End User refer to You as a user of this Site. You agree to the terms and conditions outlined in this Agreement with respect to this website without limitation. The Site consists of information services and content provided by WebLinkFavs.com, its affiliates and third parties. The term "Community Areas" means the bulletin boards, forums, poles, chat and other interactive areas on the Site.

This Agreement constitutes the entire and only agreement between You and the Site, and supersedes all other agreements, understandings, representations, or warranties with respect to the sub-domain directory.WebLinkFavs.com website, its content, products or services.

The Site, in our sole discretion, reserves the right to modify or delete any information on the Site, Including this Agreement at any time without prior notice. You should read this page each time you access the site. The latest Agreement will be posted on this web page. You are solely responsible for monitoring any changes in this Agreement.

You may view the listings on the Site as a "Guest", but to suggest a listing or category, or make a comment, you need to become a Site member. That provides us with the opportunity ot communicate with you periodically. As such you are placed on the Site mailing list. As long as you are an active member of the Site you will remain on the mailing list. Indemnification

You expressly agree to indemnify, hold harmless and defend the Site, its affiliates and their officers, employees and agents (collectively, "Affiliated Parties") from and against any and all claims, actions, suits or proceedings, as well as any and all liabilities, losses, damages and expenses, including reasonable attorneys fees and costs, arising out of, or accruing from: (a) any harm that may arise as a result of the use of the material available on the site in the treatment of patients, or use in healthcare related decisions process. (b) any material provided by You that infringes on any copyright, trademark, trade secret, patent or other intellectual property right of any third party or defames, or violates the rights of any third party; (c) any misrepresentation made by You in connection with Your use of the Site; (d) any non-compliance by You with the terms and conditions of this Agreement; and (e) claims regarding any liability, loss, claim and/or expense arising from or related to Your access and use of the Site, including information obtained through the Site. Notwithstanding the foregoing, Site reserves the right to assume at its own expense the exclusive defence and control of any matter subject to indemnification by You, in which event You will fully cooperate with the Site, it's Affiliated Parties in asserting any available defences.

 
Child Online Protection

As a Parent or legal guardian you are solely responsible for minors in your care. The Site makes no claims of suitability of any content on the web site for minors. If You have agreed to a minor in your care to use this Site, You agree that You shall be solely responsible for monitoring such Minor's access to and use of the Site and the consequences of any use of the Site by such Minor. Site not intended for children under 14 years of age.

While there is no “adult” content on any of the Sites, the material on the sites is geared to mature adult audiences requiring mature adult interpretation and judgement in relying on its content. Posting Conduct

Termination Policy

While the Site, in its sole discretion, reserves the right, but not the obligation, to terminate Your access to use the Site at any time, without prior notification and without limitations and without any refund or recourse, we will use our best judgement to not withold access unreasonably. The top three reasons for termination would be for not abiding by the posting rules of conduct, materially affecting the enjoyment of the other Users and acts by you that negatively effect the security, integrity of the Site's data script(s) and servers' ability to continue to function appropriately. We also reserve the right to persue legal remedies for such conduct.

Miscellaneous

Any dispute or disagreement of any kind between  You and Us,  with respect to this  agreement shall be resolved by binding arbitration in accordance with the laws of the province of Ontario, Canada and the then current Rules of Procedure for Commercial Arbitration of the ADR Institute of Canada, Inc. (www.amic.org) (“Institute”). The arbitration tribunal shall consist of three (3) arbitrators chosen by the parties from a slate of eight (8) proposed arbitrators provided by the Institute. If the parties are unable to agree on all three arbitrators within seven (7) days after receipt of the slate provided by the Institute, the Institute shall appoint the number of arbitrators the parties have been unable to agree upon from the slate. The decision of the tribunal shall be final and binding and no appeal shall lie there from. The tribunal shall have the power to order one party to contribute to the reasonable costs and expenses of the other party, or to pay all or any portion of the costs of the arbitration, as the panel determines in its discretion.

 The arbitration shall take place in Regional Municipality Halton, Ontario. If all parties and the arbitrator agree, arbitration may take place by telephone or by written communication. Unless the arbitrator otherwise directs, the parties, their representatives, other participants, and the arbitrator shall hold the existence, content, and result of the arbitration in confidence. No action, regardless of form, related to the obligations of the parties under this Agreement may be brought by either party against the other more than one (1) year after the cause of action has accrued. In any proceeding to enforce this Agreement, the prevailing party will have the right, in addition to its other rights hereunder, to recover its reasonable litigation costs and reasonable attorney fees.

Notwithstanding the foregoing, The Site may seek immediate injunctive relief in the event of Your infringement of intellectual property rights hereunder or a breach of Your confidentiality obligations.

 To the extent that anything in or associated with the Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed either a waiver of such provision or a waiver of the right to enforce such provision. ~

You may suggest a Site for inclusion into this directory:

Guidelines:
• Must be an English language website or English translation available.
• Must be well designed and maintained. Sites with broken links and missing images will not qualify.
• Sites must have their own domain.
• Titles and descriptions can only have capital letters only at the beginning of the words.
• Symbols and numbers are not accepted at the beginning of the title unless your url starts with a number.
• Submit only top level domains. Do not submit individual pages of the website or sub-domains.
• Submit to only one category, unless otherwise allowed.
• Spamming is not tolerated and will result in your site being banned from our directory.
• Sites with only banners and or excessive pop ups/unders will not be accepted.

If accepted, the listing is free.   Various plans are available to enhance the visibility of your listing.
Free listings being suggested must have a linkback for it to be accepted.

Posting on this site is a priviledge not a right whether posted free or otherwise. Without limiting the following, some of the unacceptable posting conduct is unacceptible and can cause immediate removal of the posting and even being barred from the site. This in part consists of language, images or links or any other form of conveyance, that conveys, promotes, incites or implies:

• obsenity
• pornography, in any form
• illegal acts
• hate and bigotry based on language, color, religion, ethnic origin, gender or sexual orientation.

Submissions posted to the Site are not necessarily reviewed by the Site prior to posting and do not necessarily reflect the opinions or policies of the Site. We make no warranties, express or implied, as to the accuracy and reliability of any content on the Site. Nonetheless, The Site reserves the right to prevent You from contributing Submissions to the Site and to edit, change and/or remove such Submissions for any reason whatsoever without prior notice and without any limitations whatsoever.

We reserve the right to:
• Refuse inclusion for any reason.
• Alter title, descriptions and keywords.
• Move your site to another category.
